Milbank LLP Litigation & Arbitration partners Antonia M. Apps and Adam Fee, and special counsel Matthew Laroche, who recently rejoined the firm after his tenure as an Assistant United States Attorney in the Southern District of New York, have authored an article on modern ransomware attacks for the Harvard Law School Forum on Corporate Governance, a leading online resource on corporate governance issues.
In the article, titled “What Companies Need to Know About Modern Ransomware Attacks and How to Respond,” the authors discuss the growing sophistication and prevalence of ransomware attacks and how companies should prepare for such attacks: “The first 48 hours following the attack are the most critical. During that time, organizations must act expeditiously to assess the attack, isolate affected systems, identify whether data is recoverable through backup files or other methods, and evaluate legal and regulatory risks, of which there are many. An organization that effectively addresses each of those issues will be in the strongest possible position to resume normal operations and determine whether or not to pay the ransom.”
